The purpose of the LCAP program is to provide landfill closure assistance to owners/permittees of landfills which were required to cease operations pursuant to certain statutory closure deadlines for non-composite lined facilities. The function of the program is to design and construct all closure related activities necessary to provide sufficient leachate management, sediment and erosion control, gas management, groundwater monitoring and a final cover cap on non-composite lined landfills, to the extent that, funds are available. On October 18, 1991 the West Virginia Legislature passed Senate Bill 18. LCAP was established by Section 22-16-3(a) of the West Virginia State Code. The program is funded by special revenue to be deposited in the Closure Cost Assistance Fund in a total amount of three dollars and fifty-cents per ton
imposed upon the disposal of solid waste at any solid waste disposal facility in this state. This fee is authorized by Section 22-16-4(a) of the WV Code.
